Developer Terms of Service & API Licence
1. Agreement and acceptance
These Developer Terms govern use of IGC Navigation, IGC Fusion, its APIs, documentation, reference data and associated services (the “Services”), provided by IGC Marketing Pty Ltd (“IGC”). They apply to free, trial and paid access unless a separately signed agreement states otherwise. Use of the Services after valid acceptance constitutes agreement to these Terms. A person accepting for an organisation represents that they have authority to bind that organisation. Merely viewing this public page does not constitute acceptance.
2. Licence and developer ownership
Subject to plan limits, payment where applicable and compliance with these Terms, IGC grants a limited, non-exclusive, non-transferable licence during authorised access to call the APIs, test integrations, create applications and provide permitted navigation functionality to end users. Developers retain ownership of independently created software, application code, designs and branding. Developers may commercialise their own applications, but may not resell standalone IGC API access or sublicense IGC proprietary technology without written authorisation. Free and trial commercial-use permissions depend on the plan terms disclosed at registration.
3. Evaluation, endpoints and plans
Developers may use authorised endpoints individually or together for research, scoping, evaluation and integration within applicable allowances. Commercial production deployment is subject to the applicable plan’s express permissions. Published documentation and plan descriptions determine available quotas, functionality, fees and supported uses. IGC may enforce reasonable rate limits and security controls.
4. IGC intellectual property
IGC retains its rights in the IGC Navigation platform, Fusion Engine, proprietary algorithms, software, API architecture, vertical positioning and virtual barometer technology, proprietary checkpoint processing, documentation, trademarks and improvements. No licence transfers ownership of these materials. Developers must not copy proprietary source code, reverse engineer protected software except where legally permitted, bypass access controls or represent IGC IP as their own. Independent interoperability and other non-waivable statutory rights remain unaffected.
5. Shared Navigation Data & Platform Improvements
IGC may retain, verify, aggregate, transform and reuse eligible, authorised non-personal technical navigation data, including reusable positioning checkpoints, floor and height references, navigable routes, technical calibration measurements and sensor-derived environmental references. To the extent developers own or control the necessary rights, they grant IGC a worldwide, non-exclusive, royalty-free, perpetual, sublicensable licence to use these eligible contributions for operating and improving IGC Fusion and to make eligible reusable references available to other authorised developers through the Services. The licence survives account closure solely for lawfully contributed eligible data. It does not include personal location histories, identifiable or reasonably re-identifiable movements, developer source code, confidential project information, sensitive security or private building data, or third-party/customer material without appropriate rights and permissions. Pseudonymisation alone does not establish that data is non-personal. Developers must hold necessary permissions and alert IGC to applicable restrictions. IGC will take reasonable steps to restrict or remove information found to be ineligible and handle personal data in accordance with applicable law and its privacy commitments.
6. Account security and API keys
Developers must protect API keys and credentials, use appropriate access controls, and promptly report suspected compromise. IGC may revoke, rotate or suspend credentials to address security issues, misuse or material breaches, consistent with applicable law. Developers are responsible for authorised use within their accounts.
7. Restrictions and lawful use
Developers must not use the Services for unlawful surveillance, unauthorised tracking, security bypass, infringement, malicious scraping, unauthorised dataset extraction or illegal activity. Developers must not misrepresent unverified navigation accuracy as guaranteed performance or use Services for life-critical decisions without express written authorisation and independent safeguards.
8. Navigation limitations and safety
Navigation precision, floor detection, route outputs and availability can vary with device sensors, environments, reference quality and network conditions. No particular accuracy or continuous service is guaranteed unless separately agreed in writing. Developers are responsible for testing their applications and implementing suitable controls for stairs, balconies, roads, restricted areas and other hazards. Emergency and safety-critical uses require separate written approval.
9. Open-source and third-party software
Certain components or integrations may be subject to separate open-source or third-party licences. Those licence terms control the corresponding components and are not overridden here. Required notices and attributions will be supplied where applicable. Developers are responsible for licences relating to their own applications and integrations.
10. Fees, billing and changes
Prices, allowances, renewal terms, taxes and usage fees are as disclosed at checkout or agreed in writing. A paid plan may renew only on the disclosed and authorised terms. Cancellation is available through the disclosed account or support process. IGC will give reasonable notice of material adverse plan or pricing changes where practicable, subject to applicable law. Statutory refund rights are not excluded.
11. Privacy, confidentiality and data processing
Each party must protect the other’s confidential information and comply with applicable privacy laws. Developers are responsible for lawful collection and transfer of their end-user data, notices and required consents. Where required, the parties will enter into separate data-processing terms. The shared technical-data licence above does not override confidentiality, privacy or third-party restrictions. Personal data will be managed under the applicable privacy policy, data-processing terms and law.
12. Changes, suspension and termination
IGC may maintain, modify or discontinue features, and suspend Services for security, legal or material misuse reasons. Reasonable advance notice of material breaking changes or planned discontinuation will be provided where practicable. Developers may cancel as permitted by their plan. On termination, API access and proprietary licences end, while accrued obligations, confidentiality, IP protections and the narrowly defined eligible-data licence survive to the extent stated.
13. Business continuity, insolvency and discontinuation
IGC does not promise indefinite operation of its business, APIs, software or infrastructure. Subject to applicable law and binding agreements, Services may end due to insolvency, liquidation, closure, financial circumstances or other legitimate business reasons. Developers independently assume responsibility for their projects, end-customer commitments, investments, backups and continuity arrangements. To the maximum extent permitted by law, IGC is not liable merely because of lawful service cessation for a developer’s project expenditure, replacement development, migration costs, lost profits, lost opportunities or claims from their customers. Unless a separate signed contract expressly requires it, IGC has no duty to transfer proprietary source code, Fusion algorithms, infrastructure or IP, or fund a replacement service. IGC will endeavour to provide notice and reasonable export opportunity for developer-owned data when practicable, but cannot guarantee this in an insolvency or immediate shutdown. Nothing in this section extinguishes lawful creditor rights or non-excludable claims.
14. Liability and legal protections
Except for non-excludable legal rights and express commitments, Services are provided without a guarantee of uninterrupted operation or fitness for every use. To the fullest extent permitted by law, IGC excludes indirect, consequential and unforeseeable commercial losses, and its aggregate contractual liability is capped at fees paid or payable for the affected Services in the prior 12 months, only insofar as that cap is valid and fair under applicable law. No fee-based cap limits rights or liabilities that legally cannot be limited, including applicable consumer guarantees or fraud. These Terms bind developers to IGC Marketing Pty Ltd as the contracting entity; they do not themselves create personal contractual obligations for its directors, shareholders or employees. This does not exclude any personal liability imposed by law, personal guarantees or wrongdoing.
15. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia, without excluding mandatory protections applicable elsewhere. The parties will first seek to resolve disagreements in good faith. Courts in New South Wales have jurisdiction subject to applicable mandatory law.
